1. Acceptance of Terms

By downloading, accessing, browsing, or using DeriPesa through our website, web application, or mobile applications (iOS and Android), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must discontinue using our services immediately.

2. Description of Services

DeriPesa operates as an automated financial gateway and verified Deriv Payment Agent. Our platform provides automated transaction software enabling users to:

  • Deposit funds into their Deriv USD trading account using Safaricom M-Pesa (via STK push).
  • Withdraw trading profits from their Deriv account directly into their registered Safaricom M-Pesa mobile money wallet.
  • Monitor transaction histories, commission earnings, and account status in real-time.

3. Eligibility & Account Verification

To access and use DeriPesa, you must:

  1. Be at least eighteen (18) years of age.
  2. Hold an active, verified Safaricom M-Pesa mobile line registered under your legal identity.
  3. Maintain an active trading account with Deriv.com in good standing.
  4. Provide truthful, accurate, and up-to-date information during registration and transaction requests.

4. Transactions, Exchange Rates & Margins

A. Real-Time Rate Quotes

All deposits and withdrawals reflect a live USD/KES exchange rate that includes a transparent operational margin. The exact amount in Kenyan Shillings (KES) and US Dollars (USD) you will send or receive is clearly calculated and displayed before you initiate any transaction.

B. Automated Execution

  • Deposits: When you submit a deposit request, an M-Pesa STK push prompt is sent directly to your mobile phone. Upon entering your M-Pesa PIN, Safaricom confirms the payment, and funds are automatically credited to your Deriv account.
  • Withdrawals: Once authorized via Deriv cashier protocols, cashouts are automatically disbursed to your designated Safaricom phone number.

C. Registration & Account Maintenance

DeriPesa charges zero registration fees, ongoing account maintenance fees, or subscription costs.

5. Incomplete Transactions, Reconciliation & Refunds

  • In the rare event of telecom network congestion, Safaricom Daraja downtime, or temporary Deriv API latency, a transaction may be marked as "Pending" or fail to complete immediately.
  • If funds are deducted from your M-Pesa balance but fail to reflect in your Deriv wallet within fifteen (15) minutes, our automated reconciliation engine will retry or flag the transaction for immediate resolution.
  • Confirmed failed transactions that cannot be processed will be refunded in full back to the originating M-Pesa phone number or credited to the customer upon verification of the M-Pesa transaction code.

6. Cookies, Web Tracking & Analytics

When using the web version of DeriPesa (deripesa.com):

  • We utilize essential browser cookies and local storage tokens to manage secure user sessions and prevent CSRF attacks.
  • We implement Google Analytics to gather anonymous usage telemetry (such as page interactions, response times, and general browser statistics) to improve system performance and user experience.
  • By using our web application, you acknowledge and agree to this analytical tracking. You may opt out of Google Analytics at any time using standard browser extensions or privacy settings.

7. User Security & PIN Confidentiality

  • M-Pesa PIN Safety: DeriPesa and its staff will NEVER ask for your M-Pesa PIN, Deriv password, or OTP codes. Your PIN is entered exclusively on your personal device’s native SIM prompt.
  • Account Security: You are responsible for safeguarding access to your mobile phone, email, and DeriPesa credentials. Any action initiated from your authenticated phone number or login is presumed to have been authorized by you.

8. Prohibited Conduct

You agree not to:

  • Use DeriPesa for money laundering, terrorism financing, or unauthorized commercial arbitrage.
  • Initiate transactions using payment credentials, M-Pesa lines, or Deriv accounts that do not belong to you.
  • Attempt to tamper with, decompile, reverse-engineer, or compromise the platform’s security or APIs.
  • Submit fraudulent reversal claims or abuse customer support channels.

9. Regulatory & Payment Agent Disclosure

  • DeriPesa is an independent payment agent operating via Deriv API standards.
  • Notice: Deriv is not affiliated with any payment agents. Customers deal with payment agents at their sole discretion and risk. Customers are advised to check the credentials of payment agents and verify information before trading.
  • DeriPesa complies with applicable Kenyan financial regulations and international Anti-Money Laundering (AML) standards.

10. Limitation of Liability

To the maximum extent permitted by applicable law, DeriPesa shall not be held liable for:

  • Delays, failures, or disruptions caused by third-party systems, including Safaricom M-Pesa maintenance or Deriv server outages.
  • Loss of trading profits or financial outcomes resulting from market fluctuations during transaction processing.
  • Errors caused by user input, such as entering an incorrect phone number or mismatched Deriv account ID.

11. Termination & Account Restriction

We reserve the right to suspend or terminate access to DeriPesa without prior notice if we detect fraudulent activity, violation of these Terms, or upon directive from law enforcement or regulatory authorities.

12. Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Kenya. Any legal action or dispute arising from these Terms shall be resolved through negotiation in good faith or submitted to the competent courts of Nairobi, Kenya.
